ESA Housing Rights in Colorado

Colorado provides ESA housing protections under both federal FHA and state civil rights law. The Colorado Civil Rights Division enforces housing discrimination complaints involving ESAs. HB 21-1161 strengthened requirements for ESA documentation, requiring providers to have a bona fide provider-patient relationship before issuing ESA letters.

Landlord Rules in Colorado

Cannot charge pet deposits or pet rent for documented ESAs
Must make reasonable accommodations even in no-pet housing
Cannot impose breed, size, or weight restrictions on ESAs
ESA letters must come from providers with a bona fide therapeutic relationship per HB 21-1161
Must respond to accommodation requests within a reasonable timeframe
Cannot retaliate against tenants who request ESA accommodations
